Terms of business - for tenants

There terms will apply for all tenants and applicants.


 

1. Applicant Declaration

By submitting an application, you confirm that:

  • All information provided is true, complete, and accurate.
  • You understand this is not a guarantee of tenancy, and subject to landlord approval and referencing.
  • You authorise Landlo and our referencing provider (HomeLet) to verify your information with relevant third parties (e.g. landlords, employers).

 


 

2. Submission Requirements

To be considered, each applicant must submit:

  • A valid passport (or driving license).
  • Proof of current address (dated within the last 3 months).
  • For non-UK citizens: a government share code to confirm Right to Rent.

Applications will not proceed unless all required documentation is received for every applicant.

 


 

3. Holding Deposit

If your offer is accepted in principle, a holding deposit equal to one week’s rent will be required.

Once received:

  • The property is taken off the market/ further viewings cancelled.
  • The holding deposit is deducted from your first month’s rent if the tenancy proceeds.

We may retain the holding deposit if:

  • You withdraw your application.
  • You fail a Right to Rent check.
  • You do not take reasonable steps to progress the tenancy.
  • You provide false or misleading information (e.g. undeclared CCJs, incorrect income).
  • Referencing is not completed within 15 calendar days (or any agreed extension).

 


 

4. Referencing & Affordability

All applicants (and guarantors, if required) will undergo referencing through HomeLet.

You’ll receive a link to complete within 24 hours of paying your holding deposit.

Affordability:

  • Combined household income must meet the affordability criteria.

A guarantor will be required if:

  • You’re under 18.
  • You don’t meet the affordability criteria.
  • You have a poor credit history (e.g. CCJs, IVAs, bankruptcy).

Guarantors must also pass referencing and sign a legal guarantor agreement.

 


 

5. Right to Rent

As required by UK law, applicants must prove their legal right to rent under the Immigration Act 2014. This may involve providing documents or a Home Office share code, which we’ll check using a government-approved method.

 


 

6. Tenancy Agreement & Legal Responsibility

Once referencing is completed successfully:

  • We’ll confirm a move-in date.
  • Your tenancy agreement and other paperwork will be sent via our secure signing platform.

If more than one tenant signs the tenancy:

  • You will have joint and several liability. This means each tenant is responsible for:
    • The full rent amount.
    • Any damages or breach of the tenancy terms.
    • All tenancy-related costs (cleaning, repairs, etc.).

Important: Tenancy agreements are legally binding. Neither party can end the tenancy early during the fixed term unless specifically allowed under the agreement.

 


 

7. Renewals

Landlo will aim to contact you before your tenancy ends to discuss renewal.

  • The landlord may offer: A new fixed-term agreement, A periodic (rolling) tenancy, Or decline renewal entirely.

Renewals are always at the landlord’s discretion.

 


 

8. Initial & Ongoing Payments

Before move-in, you must pay in cleared funds:

  • A security deposit (no more than five weeks’ rent).
  • The first full month’s rent.

Ongoing Rent:

  • Rent must be paid monthly in advance,
  • By single standing order,
  • On or before the rent due date stated in your tenancy agreement.

Your deposit will be protected in a government-approved deposit protection scheme. A certificate will be issued after move-in.

 


 

9. Property Condition

  • The property is let as seen at the time of your viewing, unless we confirm otherwise in writing.
  • Any agreed changes or repairs must be confirmed in writing before move-in.

 


 

10. Insurance & Utilities

Insurance:

We strongly recommend you take out contents insurance to cover:

  • Your personal belongings,
  • The landlord’s fixtures and fittings (in case of accidental damage).

Utilities:

Landlo may work with a third-party utility switching provider. They may contact you to help set up:

  • Gas and electricity,
  • Water supply,
  • Broadband and other essential services.

This helps ensure a smooth transition on move-in day.

 


 

11. Use of Personal Information

Your personal data will be used only to process your tenancy application.

We may share your information with:

  • Our referencing partner (HomeLet),
  • Credit reference agencies,
  • Debt recovery services,
  • Any utility provider/ council tax or utility switch providers.
  • Law enforcement or government authorities where legally required.

Your data will be handled in accordance with:

  • The UK General Data Protection Regulation (UK GDPR),
  • The Data Protection Act 2018.

12. Additional Permitted Fees

Under the Tenant Fees Act 2019, we may charge fees for specific circumstances, such as:

  • Lost keys or security devices,
  • Late rent payments,
  • Breaches of tenancy terms (e.g. unauthorised alterations, missed appointments).
